By installing or using the Shvila mobile application, you agree to these Terms of Service. If you do not agree, do not use the app.
Shvila is a mobile app for planning and recording a trip. It provides:
Shvila is designed to be deployed by its user. Each deployment runs in the Amazon Web Services account of the person or organisation that set it up, and that party - the "operator" - hosts and controls the data. There is no shared service, and the app's publisher does not host your trips or hold your data.
This means the operator, not the publisher, is responsible for the availability, backup, retention and deletion of the data in their deployment, and for the AWS charges it incurs. Where you were invited to a trip by someone else, that operator is your point of contact for anything concerning the data.
Accounts are created by invitation only; there is no self sign-up. You are responsible for keeping your password and any multi-factor authentication device secure, and for activity under your account. The operator of a deployment can create, change the role of, and remove any account in it.
Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for personal, non-commercial use.

You retain all rights in the trips, documents, photos, notes and ratings you create or upload. The publisher claims no ownership of them and, because they are stored in the operator's own AWS account, does not receive them. You are responsible for the legality of the content you upload and for having the right to share it with the other members of a trip.
The app depends on services it does not operate: OpenFreeMap and OpenStreetMap for map tiles, a geocoding provider (Photon by default; Nominatim or Google Places Autocomplete if the operator configures them) for address search, and the Wikipedia API for place information. These are provided by third parties on their own terms and may change, rate-limit or become unavailable. Map data displayed in the app is attributed to its source in the app, and remains subject to that source's licence. No warranty is given for these services, and their content - including place information, addresses and coordinates - may be inaccurate.
The app is provided as-is and may be changed, updated, or discontinued. Features described here may be added or removed in later versions. Where a version becomes unsupported, the app may require an update before it can continue to be used.
The app includes open-source software, including React Native, Expo and MapLibre GL, each used under its own licence. Those licences govern the components they cover.
To the maximum extent permitted by law, the app is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. No warranty is given that the app will be uninterrupted or error-free, that data will not be lost, or that the itinerary, distance, timing, address or map information it shows is accurate. Do not rely on the app as your only record of a booking, or as your only copy of a document.
To the maximum extent permitted by law, neither the publisher nor the operator of a deployment shall be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost data, lost profits, or missed travel arrangements, arising out of or in connection with your use of the app. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
These Terms apply while you use the app. You may end them at any time by uninstalling it and asking the operator of your deployment to delete your account. An operator may terminate your access to their deployment at any time.
These Terms are governed by the laws of [JURISDICTION], and the courts of
[JURISDICTION] have exclusive jurisdiction over any dispute arising from them,
without prejudice to any mandatory consumer protections available to you where you live.
These Terms may be updated. The effective date at the top changes when they are, and continued use of the app after that date constitutes acceptance of the updated Terms.
